Today, President Trump signed executive order as a part of H1B reform to ensure the integrity of "Hire American". This is a big hit to Indian IT companies who pay less for their workers and manipulating the H1B system.

(b) In order to promote the proper functioning of the H-1B visa program, the Secretary of State, the Attorney General, the Secretary of Labor, and the Secretary of Homeland Security shall, as soon as practicable, suggest reforms to help ensure that H-1B visas are awarded to the most-skilled or highest-paid petition beneficiaries.

This executive order wants to issue H1B visas only to MOST-SKILLED and HIGH-PAID petitions. It may wipeout the current lottery system in the coming years.

There are several bills pending in the congress which can implement the "MOST-SKILLED and HIGH-PAID petitions". DOL may follow one of the those bills.

How would H1B Executive order impacts International students in USA?

It's positive news for masters students in USA as Phd and Masters are considered as high skilled degrees. Several petitions from desi companies will lack necessary wage level.

Even though they set a minimum salary level they will exempt masters students in USA from that condition.

Companies are posting very few Full-time jobs from past few years as outsourcing/contracting is attractive. This executive order will encourage companies to hire locally and bright people.

How it will protect American Jobs?

There are several instances where the experienced IT workers were replaced by labor the from the outsourcing companies. The reason for replacement is not that the outsourcing employees are better skilled than those who are laid off, but the companies are quoting less billing. This memo will prevent such things happening in future atleast to certain extent.

Small Desi Companies and CTS, TCS, Wipro, Infosys, HCL and other outsourcing giants misused the H1B system to get the wages down and layoff of American workers which caused H1B program look bad. As a result of it, More Americans are against it than ever before. Rules like this will stop the abuse and streamline the system.

This is executive order is part of 'Hire American and Buy American' slogan by Trump. By making the H1B visa difficult trump want to give chance to american workers more opportunities over H1B talent.
