• OPT Extensions are being issued with END DATE of 2/12/2016

    As you know US Court discontinued OPT 17 months extension program feb 12th 2016 onward. OPT extension program will be discontinued from that date until and unless DHS/USCIS takes an action for a new rule-making process on this issue.

    More bad news is from the USCIS decision on OPT extension cases filed recently. Student have been issued OPT extension with an end date of Feb 12th 2016 when they requested for 17 months, which means - going forward any OPT extension application will be approved until Feb 12th 2016.

    From past 1 week, OPT Student are receiving emails from universities about this issue and new end date on OPT extension applications.

    My 12 month OPT is ending in sometime between Sept 2015 and Feb 12th 2016. Can i apply for 17 month extension?

    Yes, you can apply for extension as usually.

    How long will i get my extension?

    Until Feb 12th 2015.

    How do i manage gap between Feb 12th 2016 and Oct 1st 2016 until my visa status get converted from F1 to H1B?

    Join a CPT school from the end date of OPT. Apply to Day 1 CPT schools as early as possible since no one knows what is going to happen after Feb 12th.

    What will happen to Cap-Gap?

    Since you OPT extension is expiring in Feb 2016 but you will apply for H1B on April 1st 2016, so, you can't use cap-gap. you must maintain status by joining a school or by some other means until Oct 1st 2016.

    What if my 12 month OPT is expiring after Feb 12th 2016? How to apply for extension?

    According to current rules you are not eligible to apply for OPT extension, but you can continue until the end date of 12 month OPT.

    I am currently using 17 month OPT and it will expire in Aug 2016. Can i work after Feb 12th 2016?

    No, you can't work after Feb 12th.

    Is there any chance that USCIS/DHS put back the 17-months program so that student work permit will not get interrupted during their OPT period.

    As you know this issue is already under whitehouse's radar since students completed 100k signatures and high pressure from Employer community. This is an issue of over 1 lack students who are currently using OPT program. DHS/USCIS/Whitehouse are under tremendous pressure to act quickly to save the foreign students from leaving USA.

      could it be because uscis cannot legally put a date past feb 12 until a new rule is put in place?

      This is fake news. My friend had applied for OPT extension last month as her 12 month OPT was getting over this month. And she recently got her new EAD card which clearly states it's valid till Feb "2017".

      I'm planning for M.S Spring 2016. Because of this STEM Extention issue. is this right time to prefer for M.S or should i wait till Fall 2016
