• Impact of upcoming H1B Rules on Masters in Students in USA

I have received several emails this week on h1b bills that were introduced to curb the visas. I Would like to make it clear on what those rules are and what they are intended for.

New Rules or Bills on H1B visa

There are few bills introduced after trump's inaguration as president. Few of them look for
    1) 130k salary on H1B
    2) No more masters quota. H1B only for highest paid.
    3) No more new H1Bs for H1B dependent employers(employers with more than 50% of the employees.)
    4) Ban of H1B Visa program.

No More Masters Quota & H1B only for highly paid: Is it good or bad for you?

I am sure most of these bills will advance in house or senate. The only bill that has chances of passing is - "No more masters quota. H1B only for highest paid."
This will wipe out the 20,000 visas reservation luxury that masters student has from several years. But this is good for you. Masters and Phd student were excluded from the 'highly paid' condition.

A Masters student need not be highly paid to get H1B. You just need to get paid according to LCA requirement in your area.

This bill facilitates so that Masters students can acquire maximum number of H1B visas. Isn't it good for you??

This bill prioritized masters students in two categories. 1)with STEM Degree 2) With Non-STEM Degree. Students with STEM degree will be given higher priority over non-stem students.

Is trump supportive of International students?

During his election campaign trump repeatedly said that - US will continue welcoming 'Best and Bright' students. Join a well accredited school so that there wont be any worries.

The only way that trump may put you in trouble is that he could cancel the OPT Extension. As i said earlier going forward masters student may get h1b visa easily and in first attempt since the outsourcing companies
like TCS/CTS/WIPRO/INFOSYS will not be able to pay higher wages to their employees.

New Full-Time jobs will open for maters students in USA because of advantage you have over others to get h1b visa.

    Outsourcing companied like CTS/TCS

Trump want to stop or limit the outsourcing of the job. That is good for you since jobs will be located within USA.

I think you analysis is incorrect. Let me put in my two cents.
      1. Even though it is good for 'some' H1B holders/people aiming for H1B. I do not know anyone who has a 130K job right after college including CS.
      2. I do not have a M.S. in CS. Consequently, my salary is miles away from 130K mark. Thus, for me, to assume that my company will overnight match my salary per H1B rules mentioned in the bill is a day-dream.
Unfortunately, many of us will have no option but to go back to our respective countries.

Are these bills valid for the current STEM graduates? or is it also valid for the earlier STEM graduates (passed out in FY15) and on a H1 as of now?

Dude... Please don't mislead people who are looking forward for their MS in US. Even if you grad from a top notch university, getting paid @ 130K is very rarely possible. And, getting your H1B picked could be easy; But, just imagine which company would be ready to pay as high as 130K for a college grad, who does not even have a US work experience or at least 3-4 years of industry experience.

On other hand, there is a proposal to cancel OPT extension program too. If that is approved, let aside you getting a job worth 130K to file; you can't even stay in US after 12months OPT to try your best to get a 130K paying job and then get your H1B filed.

So, my dear students/aspirants... Please come to US only if you have a very good family fortune back home. Don't come here with the dreams of easy money and life. Gone are such days. At least, for the next two years, please don't come to US for studies unless you are from well to do families.

What if the annual salary is way less than 130K? Will that on-OPT employee be granted H1 visa?

Do you know if the rule is already effective? If not, any insights weather that's going to happen before or after March? Thank you

But aren't these laws applicable to all those who wish to get a H1B? So how come a masters degree holder has to just get paid to gen an H1B? Won't he be considered to be paid 130k at first place and then he will be eligible for a H1B?
      Please answer.

**Masters and Phd student were excluded from the 'highly paid' condition.**

Are you sure about this?? I went through a lot of articles (the proposed bill itself) these past few days and none seem to mention this VERY important piece of information.

But in the Bill, it was not mentioned that masters students are exempted from this salary hike of 1,30000. So on what basis are you saying so?
      Thank you
